Frequently Asked Questions Regarding Dismissed Photo Radar Citations at Northbound Intersection of Highway 99 and SW Tualatin-Sherwood Road. 

1. Which tickets have been dismissed?
   Tickets issued for northbound travel at the intersection of HWY 99W and SW Tualatin-Sherwood Rd. between October 2 and December 8, 2023, for traveling at a speed of below 56 MPH have been dismissed.

2. Do I need to come to court to have my citation dismissed?
   No. The municipal court judge has signed an order dismissing citations that meet the description above. You do not need to appear in court for your ticket to be dismissed.

3. What if I already paid my fine?
The City will issue refunds to those who already paid fines for dismissed citations.

4. How long until I can expect to receive my refund?
The City is working to have all refunds issued on or before March 31, 2024. Please be patient—our staffing is limited.

5. Will the citation be removed from my record?
   Yes. The city will notify the Department of Motor Vehicles (DMV) within 60-90 days of the date of dismissal (January 5, 2024). You will receive a signed copy of the order of dismissal via US Mail.

6. What if I opted for traffic school diversion, but still haven’t completed the class?
   Your citation will be dismissed, and you are no longer required to complete the online course.

7. What if my ticket was issued for southbound travel at this intersection?
   Southbound tickets have not been dismissed because the signage was acceptable for that direction of traffic.

8. What if my ticket was for 56 MPH or more?
   Citations issued for traveling 56 MPH or higher are still valid as they violate the designated speed limit by 11 MPH or more. You or your lawyer may argue your case to the Court in the normal course. The Court may amend the citation to correct the classification (for example, Class B to Class C), which could lower the amount of the fine. Upon conviction, these fines must be paid. Those who have already paid a higher fine may be refunded the difference.

9. If my ticket was not dismissed, what about the work zone enhancement?
   Tickets issued for traveling northbound at a speed of 56 MPH or higher are still subject to the work zone enhancement.

10. What if the dismissed ticket affected my insurance?
   The city will work diligently to remove all of the dismissed citations from DMV records as soon as possible. As previously mentioned, the city will also mail you a copy of the signed order of dismissal. You should discuss any remaining issues with your insurance provider directly.

11. What if I have a failure to appear associated with this ticket?
   Any penalties associated with a dismissed ticket will be vacated.
