Notice of Mandatory Adjustments Exemption Application
The city submitted an exemption request to the HAPO
The city submitted an exemption request to the HAPO on September 22, 2025, and during review of the city’s application, the mandatory adjustment provisions of Senate Bill 1537 (2024 Session) do not apply until the HAPO issues a final decision, which must be issued within 120 days or by January 20, 2026. Interested parties may sign up to receive public notice for the city’s application on DLCD’s Housing GovDelivery, including a 45-day opportunity to submit public comments during the 120-day review period.
Because the City of Sherwood has submitted a pending SB 1537 exemption application to DLCD, the City will apply its local adjustment review process in lieu of the mandatory adjustment provision of SB 1537. Adjustment requests will be reviewed under Sherwood Municipal Code (SMC) 16.84 and any related procedures.
Applicants for the development of housing may request an adjustment to the following categories of standards under the City’s local process:
- Dimensional standards, including setbacks, lot coverage, and building height
- Residential design standards that are clear and objective
- Site design requirements related to landscaping, open space, and screening
- Off-street parking ratios
A full list of eligible standards for adjustments and the relevant procedures and approval criteria may be found under:
SMC 16.40 Planned Unit Developments
SMC 16.68 Infill Development Standards
