Proposal: The applicant is requesting land use approval for a Type II Major Modification to modify condition of approval #7 of LU 2021-014 SP. The original approval is for site grading activities on two tax lots (2S133BB00100 and 2S1330000400) to prepare the site for future industrial uses consistent with those allowed in the Employment Industrial (EI) zone. The Applicant is proposing to modify Condition #7 to remove the cap of 5,000 CY of material import and export from the site. The applicant is now proposing to haul off additional rock material that is unsuitable for future industrial development, import suitable material and continue necessary site grading to balance the site and support future development in the Tonquin Industrial Employment Area.

Decision Maker: the City of Sherwood Planning Director’s decision on Kerr Site Grading Major Modification (LU 2023-002 MM) shall be made after consideration of public comments, but without a public hearing. The decision will be made no earlier than March 31, 2023 to allow adequate time for the submittal of public comments. 

The applicable code criteria include: Sherwood Zoning and Community Development Code (SZCDC) Chapter 16.90 Site Planning

Provide your comments in writing by March 31, 2023 by 5:00 pm. Written statements may be submitted to the Planning Department, City Hall, 22560 SW Pine Street, Sherwood, OR 97140 or emailed to the staff contact listed above. Public testimony should be limited to the applicable code criteria or other applicable City or State land use standards. Only those persons who submit written comments may appeal the decision. Failure to raise an issue accompanied by statements or evidence sufficient to afford the decision-maker and the parties an opportunity to respond to the issue will preclude appeal on said issue to the Planning Commission.
