Medical Marijuana Regulation Information
Background
Medical marijuana has been available in Oregon for 16 years when Oregon voters approved Ballot Measure 67, which allowed medical use of marijuana in Oregon and established a state-controlled permit system. In 2013, Oregon passed a law that established a medical marijuana dispensary program regulated by the Oregon Health Authority (OHA). The following year, the Oregon Senate adopted Senate Bill 1531, authorizing local jurisdictions to regulate medical marijuana dispensaries (MMDs).
State law requires that dispensaries can only be located in the commercial, agricultural, industrial, or mixed-use zone, and be at least 1,000 feet from any elementary or secondary school and 1000 feet from any other dispensary. Dispensaries cannot grow marijuana at the same location where medical marijuana is available and there must be security cameras in place. No mobile vending is allowed.
Local Action
Earlier this year, the Planning Commission and City Council began the process to decide whether the City should impose additional regulations beyond the OHA’s regulations for operating medical marijuana dispensaries in Sherwood.
The Planning Commission held several public meetings about regulating medical marijuana dispensaries. Community members shared thoughts, ideas and concerns about medical marijuana dispensaries. An online Medical Marijuana Dispensary Community Survey was also conducted from March 6-31, 2015. Results of the survey can be found at the link below.
The survey results and community discussion, Police Chief Groth’s comments, along with recommendations from the Police Advisory Board helped to inform the Planning Commission's recommendation to the City Council for changes to the Sherwood Zoning and Development Code. The City Council adopted Ordinance 2015-005 on May 5, 2015.
The City Council approved additional restrictions beyond the state rules that:
- limit dispensaries to the light and general industrial zones only
- limit the size of dispensary to no more than 3,000 square feet
- limit the hours of operation to between 10 am - 8 pm
- a dispensary could not be located within 1,000 feet of a public park or plaza
- provide a Type II staff level land use process under a special use criteria and notice to the property owners within 1000 feet of the proposed dispensary
