Projects Affected by the Land Use Time Extension

On April 6, 2010 the City Council approved Ordinance 2010-006 which amends the time extension provisions of the land use approval process, §16.90.020(6) (Site Plan), 16.124.010 (Subdivision), and 16.128.040 (Partition) of the Sherwood Development Code to allow applicants who received preliminary land use approval from January 1, 2007 through December 31, 2009 have until December 31, 2013 to begin construction of their project or record the final plat for partitions and subdivisions.

For projects approved between 2007 and 2009 there have been many financial and other uncertainties beyond the normal control of the applicants that lead applicants and developers to put their projects on hold and not begin construction. Multiple developers have requested a second extension or longer extensions in order to avoid expiration of the land use approval, which the City has been unable to grant. This amendment to the Development Code allows developers who had already received land use approvals, a longer period to develop their projects. By extending the qualified approvals, this land use ordinance will have the positive effect of allowing development to proceed when the economy has recovered. This will help avoid the redundancy of a re-application and thus save the applicant time and money.
